Enerzas is a marketplace platform only. We do not provide, supervise, or guarantee any specialized service listed on this platform. All vendors are independent third parties solely responsible for their own licensing, certifications, insurance, bonding, and regulatory compliance. Enerzas assumes no liability for any service performed, injury, environmental damage, property damage, or loss of any kind arising from any engagement made through this platform. Users engage vendors entirely at their own risk and are solely responsible for verifying all credentials, insurance, and qualifications before work begins.
Enerzas operates exclusively as a marketplace connecting users with independent specialized service providers. Enerzas is not a party to any service agreement, does not employ or supervise any service provider, and does not control the manner in which any service is performed. The relationship created through this platform is solely between the engaging party and the service provider.
All service providers listing on Enerzas must hold and maintain all licenses, certifications, permits, insurance, and bonding required by applicable law in every jurisdiction where they operate. This includes but is not limited to: general liability insurance, workers compensation coverage, professional certifications, operator tickets, environmental permits, and any industry-specific regulatory requirements. Service providers must upload proof of insurance before their listing goes live and must re-confirm annually. Enerzas reserves the right to suspend or remove any listing at any time.
Certain services available through this platform — including but not limited to remote site rescue, medical standby, helicopter airlift operations, wildfire interface work, and swift water rescue — carry inherent risks that may result in serious injury or death. Engaging parties must conduct thorough due diligence, independently verify all vendor qualifications and insurance coverage, and assume full responsibility for any decision to engage these services. Enerzas provides no warranty, representation, or guarantee regarding the competency, licensing, or suitability of any vendor for any particular task.
Vendors offering environmental assessment, permitting, spill response, or remediation services are solely responsible for compliance with all applicable environmental regulations including but not limited to federal, provincial, state, and municipal requirements. Enerzas assumes no responsibility for environmental compliance, regulatory violations, or remediation costs of any kind.
Enerzas performs a basic review of uploaded insurance certificates as a condition of listing. This review does not constitute a guarantee of coverage adequacy, policy validity, or vendor insurability. Engaging parties are responsible for independently verifying that any vendor holds adequate and current insurance coverage for the specific scope of work being engaged.
Any disputes arising from engagements made through this platform are solely between the engaging party and the service provider. Enerzas is not responsible for resolving disputes, does not mediate service disputes, and is not liable for any damages, costs, or losses arising from any such dispute.
To the maximum extent permitted by applicable law, Enerzas Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind arising from the use of this platform or any service engaged through it, including but not limited to personal injury, death, property damage, environmental damage, business interruption, or loss of revenue.
Both service providers and engaging parties agree to indemnify, defend, and hold harmless Enerzas Inc., its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including legal fees) arising from their use of the platform, any service performed or engaged through the platform, or any violation of these terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings must be brought in the courts of Ontario, Canada.
